On June 22, 2000 the Securities and Exchange Commission issued Regulation S-P, which governs the "Privacy of Consumer Financial Information." Consistent with our long standing commitment to protect the confidentiality and security of information about our customers and to comply with Regulation S-P we established this policy.
1. This privacy policy applies to all current, future and past customers of The Benchmark Company LLC. We intend to provide our privacy policy to new customers when they open an account with us and annually after that. If we change our policy we will notify you in advance.
2. We obtain non-public information about you from the following sources:
Information received from you as part of the account opening process (such as your name, address and social security number) or as a result of other requested services.
Transactions executed in your account by us. This information may include securities transactions, account positions and balances. This information is provided to and is also maintained by our clearing broker, Bear, Stearns Securities Corp., in accordance with our agreement with them. This information allows them to generate confirmations, statements and other required reports on your behalf.
Information that we may receive from credit reporting agencies that has been provided to Bear, Stearns Securities Corp. by third parties.
From other sources with your consent (for example, from other financial institution if you transfer an account to us).
3. We do not disclose non-public personal information about you to anyone except as enumerated above, to Bear, Stearns Securities Corp. or as required by law or statute, to various government agencies, law enforcement officials, industry self regulatory agencies and as indicated by you.
4. If you decide to close your account(s) or become an inactive customer, we will continue to adhere to the privacy policies and practices as described in this notice.
5. The Benchmark Company LLC. restricts access to your personal and account information to those employees who need to know that information to provide products or services to you. The Benchmark Company LLC maintains physical, electronic, and procedural safeguards to protect your nonpublic personal information.
You should receive a copy of Bear, Stearns Securities Corp.'s privacy notice under separate cover. Should you decide to opt out of our privacy protection plan, you must do so in writing by certified mail to our Compliance Department, and we will close your account and remit all funds and securities to you.
